  • Mike never responded to my request

      I bought a property from Mike Phillips as the seller, not the selling agent. He had purchased the property from an auction. A few weeks after I moved in, I decided to remodel my master bathroom that had a separate shower stall and bathtub. When the tub and shower were taken out, the exposed floor had several holes and thousands of rat droppings! Three of my neighbors had told me that there were previous rat problems, but nothing was disclosed in the disclosure paperwork of the sale. I called my homeowners insurance and they estimated the repair to be about $4,000. They would not cover the costs because it was an infestation that started before I bought the home. An expert pest control inspector was called and stated in his report "Due to the moderate amount of rodent feces and urine staining found and the size of the holes on the sub floor it appears there has been a rodent problem for quite some time." In addition, Mike was asked to cover up all entrances to the property where rodents or insects could enter. Mike said that he did, but he did not. The pest control company wants $891 to do this work. I have contacted Mike's real estate agent, who contacted Mike, but he will not respond. Now my only recourse is legal action.
